These Terms of Service govern your use of the Otis Mercantile website and any purchase made through our online store.

Throughout these Terms, “Otis Mercantile,” “we,” “us,” and “our” refer to Otis Mercantile LLC, doing business as Otis Mercantile. “You” refers to any person who visits our website, creates an account, submits information, or purchases a product from us.

By visiting our website or purchasing from Otis Mercantile, you agree to these Terms of Service, together with our Privacy Policy, Shipping & Returns Policy, and any other policies posted on our website. If you do not agree to these Terms, please do not use the website.

1. Eligibility and Acceptable Use

By using this website, you confirm that you are at least the age of majority in your state or country of residence, or that you have permission from a parent or legal guardian to use the website.

You may use the website only for lawful purposes. You may not use our products, website, content, or services in any way that violates applicable laws or regulations or infringes the rights of another person.

You may not attempt to interfere with the operation or security of the website, introduce malicious code, access restricted areas, collect information about other users without permission, or use the website for fraudulent activity.

2. Products and Availability

Otis Mercantile offers candles, home fragrance, textiles, accessories, and other home and lifestyle goods.

Many of our products are made, sourced, or released in small quantities. Availability is not guaranteed, and a product placed in your cart is not reserved until checkout is successfully completed.

We reserve the right to limit quantities, discontinue products, restrict sales to particular customers or locations, or cancel orders when reasonably necessary.

Product colors, materials, finishes, proportions, and packaging may vary slightly because of differences in screens, lighting, photography, manufacturing, and the small-batch nature of certain products. We make reasonable efforts to present our products accurately but cannot guarantee that every image or color displayed on your device will be exact.

3. Candle and Product Safety

Candles must always be used according to the safety instructions provided with the product or displayed on its label or product page.

Never leave a burning candle unattended. Keep candles away from children, pets, drafts, flammable materials, and unstable surfaces. Trim and maintain the wick as directed, place candles on a heat-resistant surface, and discontinue use when the remaining wax reaches the level indicated in the candle-care instructions.

Room and linen sprays must be used only as directed. Do not ingest them, spray them near an open flame, or apply them directly to the body, pets, delicate finishes, or fabrics without first testing an inconspicuous area.

You are responsible for following all product instructions and exercising appropriate care. Otis Mercantile is not responsible for damage or injury resulting from misuse, improper storage, failure to follow safety instructions, or use of a product for an unintended purpose.

4. Orders

Submitting an order is an offer to purchase. An automated order confirmation acknowledges that we received your order but does not guarantee acceptance.

We may refuse, limit, or cancel an order for reasons including:

• Product unavailability

• Incorrect pricing or product information

• Suspected fraud or unauthorized activity

• Payment authorization problems

• Shipping restrictions

• Duplicate or unusually large orders

• Errors affecting inventory or checkout

If we cancel an order after payment has been collected, we will issue a refund to the original payment method for the canceled portion.

You are responsible for providing complete and accurate billing, shipping, and contact information.

5. Prices, Taxes, and Payment

All prices are shown in U.S. dollars unless stated otherwise. Prices may change without notice, but a price change will not affect an order already accepted by us.

Applicable taxes, shipping charges, and other required fees will be shown during checkout before payment is submitted.

You agree to provide valid and current payment information and authorize us and our payment processors to charge the total displayed at checkout.

Discounts, promotional offers, and gift cards may be subject to separate conditions. Unless expressly stated otherwise, promotions cannot be combined, redeemed for cash, or applied to previous purchases.

6. Shipping and Delivery

Orders are processed and shipped according to our Shipping & Returns Policy.

Our current standard shipping structure is:

• $10 flat-rate standard shipping on qualifying orders under $75

• Free standard shipping on qualifying orders of $75 or more

Processing and delivery estimates are not guarantees. Carrier delays, weather, holidays, service disruptions, incorrect addresses, and other circumstances outside our control may affect delivery.

Risk of loss and title transfer to you when the order is delivered to the shipping address provided at checkout, except where applicable law requires otherwise.

You are responsible for reviewing the shipping address before submitting your order. Additional shipping charges resulting from an incorrect or incomplete address may be your responsibility.

7. Returns, Damages, and Cancellations

Due to the small-batch nature of our products, all sales are final except where otherwise stated in our Shipping & Returns Policy or required by law.

We do not accept returns or exchanges because of personal scent preference, change of mind, or normal variations in handmade or small-batch goods.

If an item arrives damaged, defective, or incorrect, contact hello@otismercantile.com within 5 days of delivery. Include your order number, a description of the issue, photographs of the product, and photographs of the shipping carton and interior packaging.

Please retain the product and all packaging while the claim is reviewed. Depending on the circumstances and available inventory, we may offer a replacement, store credit, or refund.

Orders cannot be canceled after they have been processed or shipped. Cancellation requests are not guaranteed.

Nothing in these Terms limits any non-waivable consumer rights available under applicable law.

8. Gift Cards and Promotional Credits

Gift cards, store credits, and promotional credits may be used only through Otis Mercantile and are not redeemable for cash except where required by law.

We are not responsible for gift cards that are lost, stolen, destroyed, or used without authorization.

9. Intellectual Property

The website and its contents, including the Otis Mercantile name, logos, product names, written copy, photographs, illustrations, graphics, designs, videos, and overall presentation, are owned by or licensed to Otis Mercantile and are protected by intellectual-property laws.

You may view and use the website for personal, noncommercial purposes. You may not copy, reproduce, modify, publish, sell, distribute, create derivative works from, or commercially exploit our content without prior written permission.

No use of the website grants you any ownership right or license beyond the limited personal-use permission described above.

10. Reviews, Messages, and User Content

If you submit a review, photograph, comment, message, suggestion, or other content to Otis Mercantile, you confirm that you have the right to submit it and that it does not violate another person’s rights.

You grant Otis Mercantile a nonexclusive, worldwide, royalty-free license to use, reproduce, display, edit, and share submitted content for operating, promoting, and improving the business, unless otherwise agreed in writing.

We may remove content that we reasonably believe is unlawful, abusive, misleading, infringing, or otherwise inappropriate.

11. Third-Party Services and Links

Our website may use or link to third-party services, including Shopify, payment processors, shipping carriers, analytics providers, social-media platforms, and other applications.

Those services are governed by their own terms and privacy practices. We are not responsible for the content, availability, security, or practices of third-party websites or services.

Your use of a third-party service is at your own discretion and risk.

Our collection and use of personal information are described in our Privacy Policy.

By using the website, you acknowledge that information may be processed by Shopify and other service providers that help us operate the store, process payments, fulfill orders, communicate with customers, and understand website activity.

13. Errors and Inaccuracies

Occasionally, the website may contain typographical errors, inaccurate information, or omissions relating to product descriptions, prices, promotions, availability, shipping, or other details.

We reserve the right to correct errors, update information, and cancel affected orders when reasonably necessary. If an accepted order is canceled because of our error, we will refund the canceled amount.

14. Disclaimer of Warranties

To the fullest extent permitted by law, the website and services are provided on an “as is” and “as available” basis.

We do not guarantee that the website will always be uninterrupted, secure, error-free, or available, or that every defect will be corrected immediately.

Products are subject to any express warranties stated on the relevant product page or required by applicable law. We disclaim other warranties to the extent legally permitted.

Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.

15. Limitation of Liability

To the fullest extent permitted by law, Otis Mercantile and its owners, employees, contractors, affiliates, suppliers, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the website, services, or products.

Where liability cannot legally be excluded, our total liability relating to a claim will not exceed the amount you paid to Otis Mercantile for the product or order giving rise to the claim, except where applicable law requires a different result.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

To the extent permitted by law, you agree to indemnify and hold harmless Otis Mercantile and its owners, employees, contractors, affiliates, and service providers from claims, losses, liabilities, and reasonable expenses arising from your unlawful use of the website, violation of these Terms, infringement of another person’s rights, or misuse of our products.

We may suspend or terminate access to the website if we reasonably believe you have violated these Terms, engaged in fraudulent or abusive conduct, or created a security or legal risk.

Provisions that by their nature should survive termination will remain effective, including provisions concerning payment obligations, intellectual property, disclaimers, liability, indemnification, and governing law.

18. Governing Law

These Terms are governed by the laws of the State of Washington and applicable federal law, without regard to conflict-of-law principles, except where the mandatory consumer laws of your place of residence apply.

Any dispute that is not subject to a mandatory alternative forum will be brought in a court of competent jurisdiction located in King County, Washington, unless applicable law requires otherwise.

19. Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the greatest extent permitted, and the remaining provisions will continue in effect.

20. No Waiver

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.

21. Entire Agreement

These Terms, together with the policies referenced on the website, constitute the entire agreement between you and Otis Mercantile regarding your use of the website and purchases from the store.

22. Changes to These Terms

We may update these Terms from time to time. The revised version will be posted on this page with an updated effective date.

Your continued use of the website after changes are posted constitutes acceptance of the revised Terms to the extent permitted by law.
